Terms of Service

By accessing or using Caliche (operated by Be Free Digital LLC, "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. We may update these terms at any time; continued use after notice constitutes acceptance.

Caliche is a civil contractor estimation platform that provides Low / Mid / High price benchmarks calibrated against real contractor bid data across 10 Texas districts statewide. The platform covers all major civil scopes including underground utility, storm drainage, paving, earthwork, concrete, and site work. Features include bid schedule analysis, market pricing, bid board access, win/loss tracking, and Excel export depending on your subscription tier.

Caliche is a decision-support tool. All estimates are benchmarks based on historical data and should not be treated as guarantees of actual project costs. You are solely responsible for the bids you submit.

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your credentials.
• One account per individual or organization. Sharing credentials is not permitted.
• We reserve the right to suspend or terminate accounts that violate these terms.

Caliche offers subscriptions (Starter at $249/mo, Professional at $599/mo, Enterprise at $1,999/mo) billed monthly or annually. All new accounts include a 14-day free trial with no credit card required. Subscriptions are billed in advance and auto-renew until cancelled. You may cancel at any time; access continues through the end of the current billing period with no proration.

Prices may change on 30 days' written notice to the email on file.

You agree not to: reverse-engineer the platform, scrape or bulk-download pricing data, share your account or subscription access, use the platform for any illegal purpose, or attempt to circumvent usage limits. We reserve the right to terminate any account for abuse.

Market Intelligence data — including indexed bid prices, contractor profiles, agency profiles, watchlist exports, segment breakdowns, and trend data — is licensed for your own internal bidding and procurement use only. You may not redistribute, resell, publish, syndicate, or otherwise make this data available to any third party, including via screenshots, exports, derivative datasets, or automated relay. You may not use the platform to populate a competing pricing or market-intelligence product. We log all market-data requests and may detect, alert on, suspend, or terminate accounts exhibiting patterns consistent with bulk extraction or redistribution.

All software, pricing models, data compilations, and platform content are owned by Be Free Digital LLC. Your uploaded bid schedules remain your property. By uploading, you grant us a limited license to process and return pricing output to you. We do not sell or share your uploaded data with third parties.

The platform and all estimates are provided "as is." We make no warranty that estimates are accurate, complete, or fit for any particular bidding purpose. Market pricing reflects historical bid data and may not reflect current market conditions. Use all outputs at your own professional discretion.

To the maximum extent permitted by law, Be Free Digital LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost profits or lost bids. Our total liability for any claim shall not exceed the fees you paid in the 3 months preceding the claim.

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Harris County, Texas.
